When Do Canadian Permanent Residents Need a Permanent Resident Travel Document (PRTD)?

The Statutory Requirement for Commercial Travel

Under section 31(1) of the Immigration and Refugee Protection Act (IRPA), a permanent resident outside Canada who does not hold a valid status document (such as a valid PR card) must obtain a Permanent Resident Travel Document (PRTD) before boarding a commercial carrier (airplane, boat, train, or bus) bound for Canada.

Commercial transportation companies are subject to carrier sanctions under Canadian law and will deny boarding to any passenger asserting permanent resident status without either a valid PR card, a Single-Entry PRTD, or a valid Canadian passport (if a dual citizen).

Meeting the Residency Obligation (730 Days Rule)

To be issued a PRTD, an applicant must demonstrate that they have satisfied the residency obligation set out in IRPA section 28. Specifically, the applicant must have been physically present in Canada for at least 730 days in the five-year period immediately preceding the application date.

If an applicant has been a permanent resident for less than five years, they must demonstrate that they can satisfy the 730-day threshold within the first five years of becoming a permanent resident.

Credit toward residency days may also be granted if the applicant was accompanying a Canadian citizen spouse or common-law partner abroad, was employed full-time by a Canadian business or public service abroad, or was accompanying a permanent resident spouse employed abroad.

What Happens If Residency Days Fall Short?

If a permanent resident has not accumulated 730 days of physical presence and does not meet statutory exceptions, an immigration officer will assess whether Humanitarian and Compassionate (H&C) considerations—including the Best Interests of any affected Child (BIOC)—warrant the issuance of a PRTD.

If the officer refuses the PRTD on residency grounds, a formal determination of loss of permanent resident status is made under IRPA section 44. The applicant has a statutory right of appeal to the Immigration Appeal Division (IAD) within 60 days under IRPA section 63(4).

Urgent Application Procedures

PRTD applications are submitted electronically through the IRCC Permanent Residence Portal. In situations involving sudden bereavement, serious illness, or urgent business requirements, applicants may request expedited processing by providing verified proof of urgency and confirmed travel itineraries.
